PRESS RELEASE: Group Calls for Termination of MCS Deputies for Shooting Dog
Primary tabs
From: The Parrinello Law Firm, LLP
When: 11:00 a.m. Wednesday October 17, 2012
What: Press conference calling for the immediate termination of MCS Deputy Shaun LeClair and Matt Clancy for unlawfully entering onto Gary Brockler’s property and, intentionally, maliciously, and without just cause, shooting and killing Gary’s beloved dog of 7 years named Diablo despite the fact that said property was well lighted and clearly posted with a dog sign facing the roadway at the beginning (“mouth”) of the driveway which said Diablo was restricted by invisible fencing.
Where: Monroe County Sheriff’s Headquarters.
130 South Plymouth Avenue
“Civic Center Plaza Upper-level”
Attendees: Teddy Loria, Gary Brockler, and all “dog lovers united & concerned citizens.”
1. The necropsy report from Cornell University and other analyses of the shots fired (“bullet’s trajectory”) at the 7-year-old pit bull, Diablo, clearly contradict both sheriff deputies police reports and indicate he was intentionally killed by someone shooting “straight downward” at him several times as he came out from underneath the garage door striking Diablo first in the right foreleg and then secondly with a 9mm bullet on the left lateral aspect of the dorsal neck killing Diablo, which is corroborated by several “downward angle” bullet holes in the base of said garage door that was raised up two (2) ft. the same height of Diablo, and not ten (10) ft. away from the garage door as they said while Diablo was “advancing aggressively” towards the deputies while standing twenty (20) ft. away from the house further down the driveway towards the street as they falsely claim in their police reports.
2. Also, the necropsy report says the bullet recovered that killed Diablo is consistent with a 9mm deforming semi-jacketed hollow point, which is not the standard issue ammunition and handgun for the Sheriff’s Office.
3. Both deputies — Shaun LeClair and Matthew Clancy — said they shot Diablo with their .45-caliber weapons, the ammunition and handguns issued by the Sheriff’s Office.
Conclusion
It appears from said facts stated above and public knowledge that Deputy LeClair and Clancy and certain members of the Monroe County Sheriff’s Office (“A-zone sub-station in Penfield, N.Y”) have a vendetta against Gary Brockler which has been ongoing for sometime and used the excuse that his car was parked illegally by blocking the sidewalk to extract their revenge against Gary by killing his beloved dog Diablo.
History: Loria who is very well known in the community to be an avid dog lover and has been extremely out spoken since the unnecessary and avoidable death of Gary Brockler’s beloved dog named Diablo on Friday June 1, 2012, by Monroe County Sheriff’s Deputies Shaun LeClair and Matt Clancy.
Loria has successfully sued the City of Rochester and various members and former members of the Rochester Police Department four separate times in Federal Court back in the 1990’s for violating his civil rights. Loria currently has a 5th, 6th, and 7th lawsuit against the City and certain members of the Rochester Police Department pending in Federal Court.
