Citizen takes Rochester Police Accountability to the Federal government

Mr.Loria spoke at the Commission set up by City Council President Lovely Warren and headed by Adam McFadden set up to review the RPD "internal investigation process" and the civilian review board, stated, "The police department make it seem like the CRB process is fair and open but everybody knows that Internal Affairs is very corrupt and extremely bias because the process favors the police".  According to Loria, "You need an independent body that has no interest in the outcome whether its favorable or not favorable--to investigate claims especially for an institution (CRB) set up to protect the civil rights of residents".  Loria said "the City of Rochester, N.Y. is a Municipal Corporation, Business like Kodak, Xerox and Wegmans, and it is imperative that as a business, they protect their interests, which is why they have to be in control of the complaint process".

The following is the Press release sent out by Citizens Against Police Brutality and Misconduct (C.A.P.B.M.) Theodore "Teddy" Loria, President, Davy "Davy V." Vara,Vice President

What: Filing of 6th Lawsuit against the City of Rochester, N.Y. and the Rochester, N.Y. Police Department.

Where: U.S. Federal Court, 100 State Street Rochester, N.Y.

When: Monday November 7, 2011 10:00 a.m.

In response to Rochester, N.Y. City Councilman Adam McFadden stating that for the past 8 years, through City Council, there has been a Civilian Review Board with Subpoena power, which the public has never known about and which hasn't been uitilized by City Council members at all, in regards to any investigation. The citizens of Rochester, N.Y. have been left with no fair and impartial agency to hear and investigate their complaints. Time and time again, it has been proven that the current and existing avenues for a citizen to file a complaint against the Rochester, N.Y. Police Department (Internal Affairs and Center for Dispute Settlement) are ineffective and both have ties and affiliation with the City of Rochester, N.Y. and it's Police Department. Therefore, I will be filing this lawsuit and asking a Federal Judge for an order to show cause hearing (injunction) against the City of Rochester, N.Y. and the Rochester, N.Y. Police Department requesting:

1. A complete and thorough investigation by the U.S. Department of Justice of the Rochester, N.Y. Police Department and their long history and systematic pattern and practice of violating citizens civil rights.

2. A Federal Consent Decree issued against the Rochester, N.Y. Police Department COPY OF 6th CIVIL RIGHTS LAWSUIT:

One of the down sides to having worked as long as I have exposing police misconduct and corruption, is that some individuals will go as far as to include you in their "so called" groups and organizations, like in the story above, which I have absolutely no affiliation with whatsoever.

On January 18, 2012, I stopped talking to “Davy V.” because he didn’t keep his word regarding a personal business matter which he asked for my help with and had nothing to do with activism.

It’s a shame that 2 ½ months later an individual is so immature as to mislead citizens & the public to make himself look like something he’s clearly not.

Here is a copy of the e-mail sent to me from “Davy V.” dated November 1, 2011, regarding my Press Release for filing my 6th lawsuit against the City of Rochester and RPD which was created by “Davy V.”, so therefore, for him to say that he had absolutely no affiliation with my “so called” group or organization shows “Davy V.’s” true character which is a straight out “jealous hater & liar.”

Davy,

I posted the original press release and it had been emailed from you, Davy V to Teddy Loria. I am aware that you and Teddy had a parting of ways, but when you posted your comment almost 5 months after the original posting of the press release, you were saying that you had never been a part of that group, which I know to be a false statement. I saw you at events and received communications between you and Teddy on behalf of the group. You created this situation by falsely claiming not to be involved with (C.A.P.B.M.). You also belittled others by your claim that you are all that and that your name was used to puff up this group. By doing that, you made me out to be a journalist that does not fact check, which is not the case.

Before you start complaining about others, take a look in the mirror. Your comment might have been made to undermine Teddy's group and/or organizations credibility, but in the process, you were also attacking my credibility and I will not stand quietly by while you do that.
