Duval served 26 years for a murder he did not commit. He was convicted on a confession obtained after 16 hours of beating by four detectives. He is now suing the City of Rochester for $100 million in damages for wrongful arrest and imprisonment. <BR>He now suffers from a serious heart condition, Hypertension, kidney damage, Hepatitis C and Post Traumatic Stress Disorder. He is expected to need Dialysis within the next six months. He works part time for $6 an hour and was receiving Medicaid assistance with his medical bills; however, he recently was notified by DSS that his case was being closed because he made too much money. <BR>His life in prison began with a brutal rape followed by an assault by another prisoner. Human Rights Watch recently released a report entitled “No Escape: Male Rape in U.S. Prisons” which found that at least one in ten inmates is sexually assaulted and the corrections officials have failed to stop this epidemic of sexual abuse. The report goes on to document the damage to prison rape victims: <BR>“Rape's effects on the victim's psyche are serious and enduring. Victims of rape often suffer extreme psychological stress, a condition identified as rape trauma syndrome. Many inmate victims with whom Human Rights Watch has been in contact have reported nightmares, deep depression, shame, loss of self-esteem, self-hatred, and considering or attempting suicide. Serious questions arise as to how the trauma of sexual abuse resolves itself when such inmates are released into society. Indeed, some experts believe that the experience of rape threatens to perpetuate a cycle of violence, with the abused inmate in some instances turning violent himself.” <BR>Representing the City, Ms. D. attempted to discredit Duval and gave a great deal of attention to his lifestyle at the time he was accused of the crime. To make her case she needs to establish his guilt using his induced confessions. At one point Ms. D. referred to the transcript of his parole hearing where he had to confess and show remorse in order to be considered for parole. The transcript indicated that he was crying during the proceeding and she asked him if he was crying because he was guilty. The trick backfired as he responded that his tears were because he couldn’t believe he made it that far. <BR>At that moment John Duval spoke for the two million incarcerated in the U.S. In fact, U.S. prisons have been cited for human rights violations because inmates are murdered by guards or other inmates. The Human Rights Watch Prison Project reports that: <BR>“Surging prison populations and public reluctance to fund new construction produced dangerously overcrowded prisons. Violence continued to be pervasive: in 1997 (the most recent year for which data were available), sixty-nine inmates were killed by other inmates, and thousands were injured seriously enough to require medical attention. Extortion and intimidation were commonplace. Most inmates had scant opportunities for work, training, education, treatment or counseling. Mentally ill inmates—estimated to constitute between 6 and 14 percent of the incarcerated population—rarely received adequate monitoring or treatment.” <BR>Ms. D. appears to be a very intelligent and competent attorney who is under pressure to win this case. It is unfortunate that she has a fool for a client and that a good person has to act as pooper-scooper for immature police officers with bad tempers. <BR>Mr. M., the other City lawyer, projects an image of power, perfection and privilege. He appears in his tailored designer suits and dentures that probably cost more than many of us make in a year. Each time he gets up to speak the room gets tense. As he cross-examined Wayne Wright, a witness for John Duval, he was hell bent to discredit the witness and the deposition in which he described how police coerced him to testify against Duval in the 1973 trial with a story fabricated by detectives. <BR>Wayne Wright responded with grace and dignity. He resisted the intimidating, badgering manner of questioning posed to him by Mr. M. Wayne Wright responded as a self-realized spiritual being who has fully embraced his destiny. The contest between the spiritual and material consciousness that we all struggle with was illuminated during this exchange. Mentally ill inmates—estimated to constitute between 6 and 14 percent of the incarcerated population—rarely received adequate monitoring or treatment.”<br /> <br />Ms. D. appears to be a very intelligent and competent attorney who is under pressure to win this case. It is unfortunate that she has a fool for a client and that a good person has to act as pooper-scooper for immature police officers with bad tempers.<br /> <br />Mr. M., the other City lawyer, projects an image of power, perfection and privilege. He appears in his tailored designer suits and dentures that probably cost more than many of us make in a year. Each time he gets up to speak the room gets tense. As he cross-examined Wayne Wright, a witness for John Duval, he was hell bent to discredit the witness and the deposition in which he described how police coerced him to testify against Duval in the 1973 trial with a story fabricated by detectives.<br /> <br />Wayne Wright responded with grace and dignity. He resisted the intimidating, badgering manner of questioning posed to him by Mr. M. Wayne Wright responded as a self-realized spiritual being who has fully embraced his destiny. The contest between the spiritual and material consciousness that we all struggle with was illuminated during this exchange. Duval served 26 years for a murder he did not commit. He was convicted on a confession obtained after 16 hours of beating by four detectives. He is now suing the City of Rochester for $100 million in damages for wrongful arrest and imprisonment.<br /> <br />He now suffers from a serious heart condition, Hypertension, kidney damage, Hepatitis C and Post Traumatic Stress Disorder. He is expected to need Dialysis within the next six months. He works part time for $6 an hour and was receiving Medicaid assistance with his medical bills; however, he recently was notified by DSS that his case was being closed because he made too much money.<br /> <br />His life in prison began with a brutal rape followed by an assault by another prisoner. Human Rights Watch recently released a report entitled “No Escape: Male Rape in U.S. Prisons” which found that at least one in ten inmates is sexually assaulted and the corrections officials have failed to stop this epidemic of sexual abuse. The report goes on to document the damage to prison rape victims:<br /> <br />“Rape's effects on the victim's psyche are serious and enduring. Victims of rape often suffer extreme psychological stress, a condition identified as rape trauma syndrome. Many inmate victims with whom Human Rights Watch has been in contact have reported nightmares, deep depression, shame, loss of self-esteem, self-hatred, and considering or attempting suicide. Serious questions arise as to how the trauma of sexual abuse resolves itself when such inmates are released into society. Indeed, some experts believe that the experience of rape threatens to perpetuate a cycle of violence, with the abused inmate in some instances turning violent himself.”<br /> <br />Representing the City, Ms. D. attempted to discredit Duval and gave a great deal of attention to his lifestyle at the time he was accused of the crime. To make her case she needs to establish his guilt using his induced confessions. At one point Ms. D. referred to the transcript of his parole hearing where he had to confess and show remorse in order to be considered for parole. The transcript indicated that he was crying during the proceeding and she asked him if he was crying because he was guilty.
