Over the last year, Benny Warr, represented by Charles F. Burkwit, has been fighting for discovery documentation for his civil lawsuit against the City of Rochester, the Rochester Police Department, and the named officers who brutalized him as he sat in his motorized wheelchair waiting for the bus on May 1, 2013. Mr. Burkwit relayed these issues regarding the current, federal case:

Spencer Ash--who represents the City of Rochester--has only handed over about half of the cases the City was ordered to disclose regarding the discovery issue in Mr. Warr's case

Mr. Burkwit subpoenaed the Center for Dispute Settlement (CDS) and the Civilian Review Board (CRB) for cases of police misconduct

The City and CDS have both moved to quash the subpoenas

Mr. Burkwit will argue to release those subpoenaed records as well as ask the court for permission to depose individuals connected to the CRB and CDS
Benny Warr and his lawyer will appear in Judge Marian Payson's federal court on Tuesday, August 25, 3:00PM at the Federal Building (100 State St.). Please come out and support Mr. Warr and the community against police secrecy and brutality.
