In the above .pdf, Attorney Charles F. Burkwit, representing Mr. Benny Warr, blasts the concluded investigation conducted by the Professional Standards Section of the Rochester Police Department into the brutality suffered by Mr. Warr at the hands of officers Joseph “Joey” M. Ferrigno II, Anthony “Rock” R. Liberatore, and Sergeant Mitchell “Big Face” R. Stewart II on May 1, 2013.

With Officer Liberatore admitting that he asked Mr. Warr "are you ready to get your ass kicked?", the officers' motive of harm is clear. Based on all the evidence, there is no explanation why a man in a wheelchair eating ice cream and lawfully conversing with others was so brutally attacked by Officers Ferrigno and Liberatore. From the foregoing evidence, Mr. Warr was acting lawfully, was not a threat to anybody and the officers did not have any lawful reason to approach, assault and arrest Mr. Warr.
