On the evening of May 1, 2013, Benny Warr traveled in his motorized wheelchair to the vicinity of Jefferson Avenue and Bartlett Street in the City of Rochester, NY. Mr. Warr went to Royals Food Market (see "1") at 598 Jefferson Ave. and purchased ice cream and Icees. He said hello to a few people and thereafter went to the Swan Bridge building (see "2") at 584 Jefferson Ave. since it was shaded. Mr. Warr was sitting in front of the Swan Bridge Building speaking with Derrick Latham when he heard Rochester Police Department officers Joseph Ferrigno and Anthony Liberatore asking a group of people who had congregated in front of Zack Mini Mart (see "3") at 580 Jefferson Avenue to leave. Mr. Warr did not know these individuals and did not speak with them. Mr. Warr never spoke with the officers since he left immediately and went across the street to the bus stop (see "4") to get out of the officers' way. When Mr. Warr arrived at the bus stop (see "4"), he waited there with Derrick Latham and Tache Young. Mr Warr then waited for the 6 Jefferson bus to head southbound on Jefferson Avenue to go visit a friend. Mr. Warr knew that the police officers were clearing the streets under the City policy Operation Cool Down and his intention was to avoid the police officers and leave the area.
On May 1, 2013 at approximately 8:15 p.m., Benny Warr was sitting in his motorized wheelcahir at the bus stop (see "4") when he was suddenly approached by RPD Officers Anthony Liberatore and Joseph Ferrigno.
